Decision of Supreme Court of Pakistan has been issued on 15-01-2018 in connection with Daily Wages Employee Eligible for Regularization. Detail is as under:
It is an admitted fact that as per the policy decision of Cabinet Division, a person who has served the National Highway Authority (NHA) for three consecutive terms of 89 days in entitle to be regularized, Respondent No.1 has served for five consecutive terms, however, the only reason put forward on behalf of NHA against his regularization is that there is a gap of 10 months, where after, he again has been appointed for further 89 days` time, which reason by itself would not debar him from the right conferred by the decision Cabinet Division, seeking his regularization on the basis of his previous service of five consecutive terms. This fact was taken into consideration by the learned Tribunal. No substantial question of law of public importance has been raised in the petition calling for interference under Article 212(3) of the Constitution of Islamic Republic of Pakistan, 1973. Dismissed accordingly.
