I shall write in detail the Period of EOL and Suspension Counts for Pension or not. Extra Ordinary Leave (EOL) is a leave that the employee takes without pay and suspension is the period during which the employee is suspended. Now discuss these two cases in detail.
Period of EOL and Suspension Counts for Pension or Not?
According to the Finance Department Punjab and other Finance Division/Departments, the answer to these questions are as under:
Whether the period of extraordinary leave shall count as qualifying service for purpose of pension?
No, all leave except, extraordinary leave shall count as qualifying service for the purpose of pension as per Rule 2.7 of the Punjab Civil Services Pension Rules.
Example/ Explanation
If the date of joining of the employee is 1st January 1975 and on 31st December 2020 if the employee has 1 month EOL, then his total service for the pension counting is not 25 years. He has to serve one month more for 25 years of qualifying service. However, if an employee has leaves with full pay or half pay then he will qualify for pensionable service.
Whether the period under suspension counts for pension
The period of suspension counts for pension if it is immediately followed by reinstatement, regardless of the fact whether the government servant was allowed full pay and allowances for the period of suspension or not. However, if the period of suspension is treated as extraordinary leave, it shall not count for pension.
Example/ Explanation
In the above statement, there are conditions for counting of service or not. The employee’s suspension period, the department can towards pensionable service and cannot be. These conditions are as under:
If re-instated immediately after the suspension period
His period of suspension as EOL
His period of suspension with full pay and allowances
In these three conditions, the 1st condition and 3rd condition are compulsory for counting of suspension period towards pension.
