Regularization of Sindh PSTs since Their Initial Appointment-Sindh High Court Decision

Last Updated on October 31, 2021 by

The Sindh High Court has made its decision on 22-12-2011 in connection with the regularization of Primary School Teachers wef the date of their 1st appointment as PST on contract basis.  The remarks of the honourable judge are as under on this decision:

We have noted that the post of Primary School Teacher is a permanent post, hence to be filled in through a permanent employment whereas in the present case petitioners worked on contract basis for four years as thereafter were regularized, therefore whenever permanent post is to be regularized then it has to be regularized from the of initial appointment. Since in various other districts of this province, service of School Teachers who have been appointed on contract basis have been regularized from the date of their initial appointment, it would amount to discrimination if the employment of the petitioners is not regularized from the date of initial appointment. In the circumstances, we declare that regularization of the petitioners shall be effective from the date of their initial joining in service i.e 2001.
