Lahore High Court Bahawalpur Bench has issued decision on 04-05-2017 in connection with Permanent Appointment under Rule 17-A. Summary of the same is as under:
Learned AAG has presented a copy of notification dated 07.05.2008 to establish that Accounts Branch is empowered to raise objection regarding permanent appointment obtained on the basis of Rule 17-A of the Punjab Civil Servants (Appointment& Conditions of Service) Rules, 1974.of
- Since this Court has already interpreted the Rule 17- A of the Punjab Civil Servants (Appointment& Conditions of Service) Rules, 1974. By virtue of judgment reported as Ali Ahmad V, Executive District Education Officer, Sialkot and another (2014 PLC (C.S) 793 wherein it has been Held that appointment under Rule 17-A of the Punjab Civil Servants (Appointment& Conditions of Service) Rules, 1974. Would be a permanent appointment and there is no concept of appointment of said incumbent on contract basis, therefore, all the replies submitted by the respondents, being contrary to low laid down by this Court, are hereby turned down and the respondents are directed to release the salary of the petitioner forthwith.
- With the above observation, this petition stands disposed of.
