A Bill further to amend the laws relating to the public representatives of the Province of the Punjab

It is expedient further to amend the laws relating to the public representative offices of the Province of the Punjab in the manner hereinafter appearing;

Be it enacted by the Provincial Assembly of the Punjab as follows:

1.         Short title and commencement.– (1) This Act may be cited as the Punjab Public Representatives’ Laws (Amendment) Act 2019.

(2)       It shall come into force at once.

2.         Amendments in Act XVI of 1974.– In the Punjab Provincial Assembly (Salaries, Allowances and Privileges of Members) Act, 1974 (XVI of 1974), the following amendments shall be made:

(i)         in section 3:

            (a)       in subsection (1), for the words “eighteen thousand”, the words “eighty thousand” shall be substituted; and

            (b)       in subsection (2), for the words “ten thousand rupees per mensem”, the words “the salary as mentioned in subsection (1)” shall be substituted;

(ii)        in section 4, for the words “one thousand” and “six hundred”, the words “two thousand” and “one thousand” shall respectively be substituted;

(iii)       in section 5-A, for the words “one hundred and twenty thousand”, the words “two hundred thousand” shall be substituted;

(iv)       in section 7-A, for the words “one thousand and five hundred”, the words “two thousand” shall be substituted;

(v)        in section 7-B:

(a)       in subsection (1), for the words “twenty nine thousand”, the words “fifty thousand” shall be substituted; and

(b)       in subsection (2), for the words “six thousand”, the words “twenty thousand” shall be substituted;

(vi)       in section 8, the following proviso be added at the end:

“Provided that an ex-Member of the Assembly shall also be entitled to free indoor and outdoor medical facilities of the same standard.”;

 (vii)     in section 10-A, for the words “ten thousand”, the words “fifteen thousand” shall be substituted;

(viii)     in section 10-B, for the words “ten thousand”, the words “twenty thousand” shall be substituted; and

(ix)       in section 11-A, in clause (ii) for the words “fifteen thousand”, the words “thirty thousand” shall be substituted.

3.         Amendment in Act II of 1972.– In the Provincial Assembly of the Punjab Privileges Act 1972 (II of 1972), after section 15-A, the following new sections shall be added:

                        “15-B. Use of VIP Lounges.— A member and ex-Member of the Assembly shall be entitled to the use of VIP lounges at all airports in the country.

                        “15-C. Official and diplomatic passport.— (1) A member and ex-Member of the Assembly shall be entitled to official passport:

                        Provided that every person who has held the office of the Speaker and Deputy Speaker under Article 108 or the office of a Minister under Article 132 of the Constitution, shall also be entitled to official passport.

                        (2) Every person who has held the office of the Chief Minister under Article 130 of the Constitution, shall be entitled to diplomatic passport.”.

4.            Amendments in Act XLI of 1975.– In the Punjab Ministers (Salaries, Allowances and Privileges) Act, 1975 (XLI of 1975), the following amendments shall be made:

(i)            in section 3, in subsection (1), for the words “thirty nine thousand rupees and thirty five thousand rupees” the words “three hundred thousand rupees and one hundred eighty-five thousand rupees” shall be substituted;

(ii)           in section 6:

(a)          in subsection (1), for the words “twenty thousand”, the words “fifty thousand” shall be substituted; and

(b)          in subsection (2), for the words “ten thousand”, the words “forty thousand” shall be substituted;

(iii)          after section 21, the following new section 21-A shall be added:

21-A.   Perks and privileges of a former Chief Minister.– Notwithstanding any other provision of this Act, every person who has held the office of the Chief Minister under Article 130 of the Constitution shall, for life time, be entitled to:

(a)          suitable and adequate security including provision of close protection services with two SUVs of engine capacity not less than 2500cc with five security personnels in each vehicle, excluding driver, which the Government shall make available;

(b)          one personal secretary and two junior clerks to be arranged by the Government;

(c)           a 1300 cc car with driver maintained at the expense of the Government; and

(d)          payment of rupees ten thousand per month as telephone allowance.”

5.            Amendments in Act XLII of 1975.– In the Punjab Provincial Assembly Speaker (Salary, Allowances and Privileges) Act, 1975 (XLII of 1975), the following amendments shall be made:

(i)            in section 3, in subsection (1), for the words “thirty seven thousand”, the words “two hundred thousand” shall be substituted; and

(ii)           in section 6, for the words “twelve thousand”, the words “fifty thousand” shall be substituted.

6.            Amendments in Act XLIII of 1975.– In the Punjab Provincial Assembly Deputy Speaker (Salary, Allowances and Privileges) Act, 1975 (XLIII of 1975), the following amendments shall be made:

(i)            in section 3, in subsection (1), for the words “thirty-five thousand”, the words “one hundred eighty-five thousand” shall be substituted; and

(ii)           in section 5, for the words “ten thousand”, the words “fifty thousand” shall be substituted.

7. Amendments in Ordinance LXXI of 2002.– In the Punjab Parliamentary Secretaries (Salary, Allowances and Privileges) Ordinance, 2002 (LXXI of 2002), the following amendments shall be made:

(i)            in section 4, in subsection (1), for the words “twenty thousand”, the words “eighty three thousand” shall be substituted;

(ii)           in section 5, for the words “ten thousand”, the words “twenty two thousand” shall be substituted;

(iii)          in section 6, in subsection (2), for the words “twenty thousand”, the words “thirty five thousand” shall be substituted;

(iv)         in section 7:

(a)          in subsection (2), for the words “twenty thousand”, the words “fifty thousand” shall be substituted;

(b)          in subsection (4), for the words “six thousand”, the words “twelve thousand” shall be substituted; and

(c)           in subsection (5), for the words “twenty five hundred”, the words “thirty five hundred” shall be substituted;

(v)          in section 10, for the words “one hundred and twenty thousand”, the words “two hundred thousand” shall be substituted;

(vi)         in section 11, for the words “one thousand”, the words “two thousand” shall be substituted; and

(vii)        in section 16, for the words “ten thousand”, the words “twenty thousand” shall be substituted.

8.            Amendments in Ordinance LXXVI of 2002.– In the Punjab Special Assistants (Salary, Allowances and Privileges) Ordinance, 2002 (LXXVI of 2002), the following amendments shall be made:

(i)            in section 4, in subsection (1), for the words “thirty five thousand”, the words “one hundred eighty-five thousand” shall be substituted; and

(ii)           in section 5, for the words “four thousand”, the words “fifteen thousand” shall be substituted.

9.            Amendments in Ordinance LXXVII of 2002.– In the Punjab Advisors (Salary, Allowances and Privileges) Ordinance, 2002 (LXXVII of 2002), the following amendments shall be made:

(i)            in section 4, in subsection (1), for the words “thirty thousand”, the words “one hundred eighty-five thousand” shall be substituted; and

(ii)           in section 5, for the words “four thousand”, the words “fifteen thousand” shall be substituted.

STATEMENT OF OBJECTS AND REASONS

The emoluments of public representatives of the Province of the Punjab are not at par with those of the sister provinces and the Federal Government. Keeping in view the recent spells of price hike and devaluation, it is essential that the emoluments of the public representatives of the Punjab are increased to a reasonable extent.
