Writ Petition No. 220388,2018, 18296/201,9, And 25359/20,24, Filed by Avesha Iftikhar, Mian Imran Saeed, and Shahajahan Usama Vs Federation of Pakistan, Before the Honourable Lahore High Court, Lahore.
As Per Judgment Dated 22-05-2025 Of the Honourable Lahore High Court in Writ Petition No. 220388-2018 Filed by Ayesha Iftikhar Vs Fop Before the Honourable Lahore High Court, Lahore, Through the Single Judgment, The Honourable Court Has Also Decided the Instant Petition as Well as The W.P. Nos. 18296 Of 2019 & 25359 Of 2024 As All Three Petitions Involve the Interpretation of Section 6 Of Cga (Appointment, Functions and Powers) Ordinance, 2001. In This Regard, The Honourable Lahore High Court, Lahore, Has Passed an Order in The Above Writ Petitions Elaborated as Under:
The Upshot of The Above Discussion Is That the Interpretation of Section 6 Of the Ordinance, As Accorded by Fazal-E-Haq Judgment Supra, Still Holds the Field and The Same Is Binding Precedent for All Intents and Purposes. Consequently, This Petition Is Allowed, Impugned Minutes and Consequent Recommendations and Decision Thereof Notified by the Cabinet Division On 17.03.2016 Are Set Aside. The Respondents Are Directed to Implement Fazal-E Haq Judgment in Letter and Spirit.
Conclusion of Facts
In Pursuance of The Above Judgment, The Controller General of Accounts, Islamabad, Vide Letter No. Casetta/Administrative Matters of Dapped/Cao Pod/2025/165/730 Dated 17-10-2025 (Annex-A) Has Required for Implementation of CA’s Notification No. 335 / CA / Establishment / 239-C / Ppo-Lhr / 2014 Dated 09-04-2015 (Annex-B). Accordingly, All The Accounts Establishments, I.E. Assistant Chief Accounts Officers, Accounts Officers, Assistant Accounts Officers, Junior Accountants, Senior Auditors, Junior Auditors And Other Staff Dealing With Accounts Either Working In The Office Of The Director Of Accounts, Pakistan Post Office Department Lahore Or The Director General, Pakistan Post Office Department Including Field Offices Of Ppod I.E. Pmgs/Gpos Have Been Placed Under The Administrative Control Of The Controller General Of Accounts Through Chief Accounts Officer, Pakistan Post Office Department.
In View of The Above, All Stake Holders Are Requested to Take Necessary Action for the Implementation of CGA’s Notification Dated 09-04-2015, In Light of The Above-Mentioned Court Order/Decisions.
