The Lahore High Court Lahore has issued its decision on 15-06-2015 in connection with Service Structure of the Laboratory Staff. The summary of the same is as under:
It is therefore respectfully prayed that the Writ Petition may kindly be accepted and the respondents may kindly be accepted directed to formulate permanent service structure and to frame the service rules for the petitioner-the Laboratory Staff of the Higher Education Department, treating the petitioner at part with the ministerial staff of the Higher Education Department and other employees of the Government Departments. Keeping in view the proposed permanent structure and service and promotion rules presented by the petitioner and the respondent No. 2 & 5 from BPS-07 to BPS-17 and benefits of the same may kindly be given from 31-08-1997 as per the order of the Honourable Lahore High Court Lahore deciding the representation of the petitioner and also keeping in view the order of the respected Governor of the Punjab dated 23-04-2012.
Taking into consideration the fact that matter with regard to service structure of the petitioner is hanging for last so many years and the departmental authorities don’t appear to be keen enough to finally put up the same before the competent authority i.e Chief Minister Punjab. I allow this writ petition with a clear direction to the authorities that the summary with regard to service structure of the petitioner shall be put up before the Chief Minster Punjab for ultimate decision thereon, in accordance with relevant rules and the precedents, if available in that respect.
