Pre 2001 Pensioners

I am here sharing the article related to pre 2001 pensioners. Mr. Agha Amir has submitted the same article for the guidance / help of the pensioners. Detail is as under:

If commuted part of your pension was restored after 30.11.2001, and you were given pension increases from 2001 onward (till restoration of commuted pension) on Net Pension (no increase was given on Commuted part of pension).

  1. Then come and join hands with us for availing the increases from 2001 onward on Gross Pension (including the commuted part of pension).

  1. Our case will be based on Lahore High Court orders in Writ Petition 17989/2016, directing government to follow the 1994 policy (of giving increases on Gross Pension), instead of reducing the benefit to Net Pension only. In this case the pensioner had retired before 2001 reforms and had challenged the 2001 orders. The High Court directed that policy valid on date of retirement be followed.

  1. There are standing directions of Supreme Court that if a litigating public servant gets certain benefit out of litigation, then all other equally placed public servants are also to be extended that benefit (instead of compelling them also to indulge into litigation).

  1. Pre 2001 Pensioners willing to join hands with us may kindly send their particulars to me at the email address / whatsapp, giving particulars listed below:

(a)     Name, post last held, date of retirement, date of restoration

(b)     Postal / email address, telephone numbers (mobile and landline)

(c)      Willingness to share expenses on consultation and litigation.

Wishing you luck

  1. Awan sahib, if you retired at the age of 60 years, then your commuted part is restorable on expiry of 12 rounded off years when your age would be 72 years.
