Peshawar High Court Peshawar issued a judgment sheet on 12-03-2020 in connection with Decision Regarding Regularization Ministerial Staff Bacha Khan University Charsadda. The detail is as under:

In essence, on the creation and establishment of the respondent-Bacha Khan University. Petitioners were appointed on various ministerial and administrative posts, on a contract basis in the year 2012 for a specified term. However, time and again the said period of contract employees was extended. On the promulgation of amended Universities Act 2016, in view of selection 11(5)e of the Act, a selection committee was constituted in order to fill up the vacant posts in university, which considered petitioners and made recommendations to the syndicate for the appointment of petitioners on contract basis for a period of one year. However, the competent authority while accepting the recommendations of the selection committee extended the contract services of petitioners for three years commencing therefrom 20-07-2016.
At the verge of expiration of their contract services, as the respondent-university failed to make a regular appointment in accordance with the law, and where, petitioners felt that as the university was not advertising their posts on which they were working on contract basis and also that the respondents in view of Section 11(5)e of University Act 2016 have no power to extend the services of petitioners. They approached this Court for their regularization as there was no chance of open competition to petitioners, on account of non-advertisement of posts, with the following relief:
It is therefore prayed that on acceptance of this writ petition an appropriate writ may kindly be issued to direct the respondents to regularize the services of the petitioner with effect from the date of appointment and issue a formal office order in this respect with all back benefits.
