Order Sheet Regularization from First Appointment Instead of With Immediate Effect

I am sharing the hearings of the Punjab Service Tribunal Lahore Order Sheet issued on 11-09-2020 regarding Regularization from First Appointment Instead of with Immediate Effect. The details are as under:

 

Order Sheet Regularization from First Appointment

 

Appellant field instant appeal under section 4 of the Punjab Service Tribunal Act, 2974 seeking setting aside of the order dated 16.03.2020. That respondent No.2 passed the to the extent of it regularizing the services of the appellant with immediate effect instead of the date of appointment under rule 17-A of Rules ibid may kindly be set aside and respondents may kindly be directed to regularize the services of the appellant from the date of his initial appointment as Junior Clerk i.e. 3.2.2015. As appointment under Rules 17-A is a regular appointment under the law.

Aggrieved of the same, the appellant filed a departmental appeal before the Deputy Commissioner, Mainwali which is still hanging fire.

  1. Learned Counsel states that the appellant would be satisfied if the direction is issued to the Deputy Commissioner, Mainwali to decide the departmental appeal of the appellant pending before him.
  2. Hence, the Deputy Commissioner, Mainwali is directed to decide the departmental appeal of the appellant if still pending in accordance with law after giving the opportunity of personal hearing to the appellant positively, expeditiously, preferably within a period of 90 days after receipt of a certified copy of this order.
  3. With this direction, the appeal stands disposed of.
