Government of Sindh, School Education & Literacy Department has issued Notification on 27-4-2020 in connection with Amendment Sindh Private Educational Institutions (Regulation and Control) Rules 2005. The details are as under:
Notification of Amendment Sindh Private Educational Institutions (Regulation and Control) Rules 2005
No: SO(PS)/SELD/Amen./Rules-2005/2020:- In exercise of the powers conferred by section 15 of Sindh Private Educational Institutions (Regulation and Control) Ordinance, 2001 (Amendment) Act-2003, the Government of Sindh are pleased to make following amendments in The Sindh Private Educational Institutions (Regulation and Control) Rules, 2005:-
AMENDMENT
In the Sindh Private Educational Institutions (Regulation and Control) Rules 2005, after Rules 19, the following new rules shall be inserted:-
“19-A. The registering authority may, in extraordinary circumstances, including but not limited to, situations of war, natural disaster, earthquake, flood, epidemic, pandemic, lockdown or any other extra ordinary event which warrants the issuance of a special order, issue a special order and shall be followed by the institution.
19-B. A special order issued under rule 19-A shall have precedence over the other rules, orders, proceedings, notifications or matters otherwise fixed in the ordinary course, issued under these rules.
19-C. The Special order issued under rule 19-A may regulate all or any of the following matters:-
- Closure of the institutions.
- Enhancement or Reduction in fees.
- Remuneration to the teachers and other staff.
- Finance matters.
- Relief and concessions.
- Health guidelines.
- Any other matter which may warrant regulation in the respect of any extraordinary circumstances.
19-D. All the previous orders and instructions issued in respect of the extraordinary circumstances including a pandemic as envisaged in rule 19-A shall be deemed to be special orders issued under 19-A unless modified, amended, suspended, or cancelled through a fresh special order.
19-E. Any person or institution aggrieved by special order may either individually or collectively file an appeal before the Chief Secretary in case of Colleges and Higher
Secondary Schools and in case of Schools the Secondary School Education Department, within a period of sixty days from the date of such special order, who shall be competent to endorse, modify, amend, set aside, and pass other consequential appropriate orders within a period of ninety days.
